By accessing and using the Tnkr platform at tnkr.ai (the “Platform”), you agree to be bound by these Terms. If you do not agree to any part of these Terms, you may not use the Platform.
Tnkr grants you a limited, non-exclusive, non-transferable license to access and use the Platform for lawful purposes, subject to these Terms and all applicable laws and regulations.

You agree to maintain the security of your account credentials and notify us immediately of any unauthorized use. Tnkr is not liable for unauthorized access resulting from your failure to secure your credentials.
You retain ownership of all content you create and upload to the Platform (“User Content”). By uploading User Content, you grant Tnkr a worldwide, royalty-free, perpetual license to use, reproduce, modify, distribute, and display such content for the purposes of operating and improving the Platform.
You are solely responsible for User Content you create or share. You represent and warrant that:
All content provided by Tnkr, including text, graphics, logos, and software, is the property of Tnkr or its content suppliers and is protected by copyright and intellectual property laws. You may not reproduce, distribute, or transmit this content without prior written permission.
Content marked as public on the Platform may be subject to open-source licenses (such as MIT, Apache 2.0, or GPL) or creative commons licenses. You must comply with the terms of the applicable license when using public content.
The Platform is provided “as-is” and “as-available” without warranties of any kind, either express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the fullest extent permitted by law, in no event shall Tnkr, its directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or use, even if advised of the possibility of such damages.
You agree to indemnify, defend, and hold harmless Tnkr and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Platform, violation of these Terms, or infringement of any third-party rights.
We may suspend or terminate your account and access to the Platform at any time, with or without cause, in our sole discretion.

Upon termination, your right to use the Platform immediately ceases. We may delete your data upon termination, subject to applicable data retention laws.
Some features of the Platform may require payment. By purchasing a subscription or service, you agree to pay all applicable fees and charges. Tnkr uses Stripe to process payments, and your payment information is subject to Stripe's privacy and terms.
Subscriptions automatically renew unless cancelled. You may cancel your subscription at any time through your account settings. Refunds are not available for partial months.
Tnkr reserves the right to change pricing with 30 days' notice. Your continued use of the Platform constitutes acceptance of new pricing.

Your use of third-party services is governed by their terms and conditions. We encourage you to review third-party privacy and terms policies before interacting with them.
These Terms are governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law principles. Any legal action or proceeding relating to these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
Before initiating legal action, both parties agree to attempt to resolve disputes through good faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration under the rules of JAMS, except for disputes involving intellectual property or injunctive relief, which may be brought in court.
Tnkr reserves the right to modify these Terms at any time. Changes will be effective upon posting to the Platform. Your continued use of the Platform following any changes constitutes your acceptance of the updated Terms. We recommend reviewing these Terms periodically for updates.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
These Terms, together with the Privacy Policy and any other terms or policies referenced herein, constitute the entire agreement between you and Tnkr regarding your use of the Platform and supersede all prior agreements, understandings, and negotiations.
